re. WAREZ - I do not condone WAREZ generally, however I make an exception with Hirens XP. The reason is that MS are the owners of the software and they simply don't care about XP! Many small shops in many countries openly sell PCs with hacked copies of XP and MS do nothing to prosecute them. In addition, Hirens CDs are openly for sale on eBay. MS could easily stop this - all they have to do is complain to eBay and eBay would not allow Hirens CDs to be sold - but they obviously have not complained. Other companies do complain if any copyright or fake articles are sold on eBay (as I found out once when I inadvertently tried to sell a counterfeit Louis Vuittons bag on eBay!). So it is clear to me that Hirens is not deemed as harming MS as they clearly cannot be bothered to even stop it's sale on eBay (or the sites that it can be downloaded from). They do however actively police sites that try to offer Win7 or 8 for download.
In other words you shift the line in the sand where you want or simply fancy it to be (it would be much more senceful to either respect or ignore it) .
And you are not respecting the author's declared will, you are pretty much convinced that you can get away with not respecting it without consequences, not entirely unlike littering the street, but only when the policemen are looking the other way.
Or only throwing away cans of Coke as they are very prevalent, and thus not really litter.
Pepsi and diet Coke are of course another thing:

About people selling it on e-bay, and how easy would it be for MS to stop that, we have already been there:

Do you have an idea of the amount of stolen goods (besides the counterfeit ones) sold every day on e-bay?
An example of someone that provided a freeware tool as non-redistributable and was actually flattered to have it included in that WAREZ release we do not have to look very far, do we?
This is from the RMPREPUSB page:
RMPrepUSB and RMPartUSB are freeware utilities for private use only - no registration is required, and all versions are unlimited versions and do not contain any adware or viruses.
Please do not distribute these utilities without the authors permission as these utilities are not 'copyright free', 'free software', 'Open Source' or 'Open Licence' products, but are products which are made available for private use at zero cost.
Commercial use (i.e. selling it or including it in another product) and/or re-distribution is forbidden and you need to contact RM for licensing costs if you wish to include or re-distribute it as part of a commercial solution.
Email: support@rm.com for multiple user licence enquiries and ask for Classroom Technologies department.
Please note: No licence is required for the internal use of RMPrepUSB by technicians/engineers within a company.
Another page on your site:
http://reboot.pro/to...ows-7/?p=167588
states how the thingy is illegal but according to your interpretation of the Law it is OK if one has a licence for XP.
Hiren's Boot CD (HBCD) is a heavily modified and illegal version of Microsoft Windows XP. However, it is very prevalent on the internet and the ISO file can be easily downloaded. If you have a licence to run Windows XP on your computer (e.g. if your computer has a Windows XP, Windows Vista Business or Ultimate or Windows 7 Professional or Ultimate Certificate Of Authenticity label on it) then you can legally run XP (but only on that computer - but not dual boot!).
Hiren's Boot CD 13.2 and later versions even includes RMPrepUSB v2.1.620, even though no permission was asked and the software is copyrighted and distribution is forbidden! However, in this case I will regard it as a form of flattery!
So, if I were to release some good WAREZ PE, would you tolerate my unathorized redistribution of your tool, as a form of flattery?
BTW, as explained in great length in other threads, there are tens of similar (or "better") WAREZ releases, wouldn't it be only too fair to the nice guys putting them together and distributing them, to shift a little bit more the line on the sand and consider them "legal if you have a proper licence" /and support them)?
Or should we wait until they are "very prevalent"? (but how can they ever become prevalent if we are not allowed to talk about them, nor support them? )
