Unlike the first case, the password on POST (BIOS Setup) is hardly can be bypassed w/o some mess. You'll need to open the case of the laptop, and disconnect a litium battery from the motherboard in order to reset all CMOS (BIOS) settings, including your forgotten password.

Where exactly the pass is set? If it is set on Vista logon, then you can use any password reseting utility, there are a hell a lot of them over the net. Hey, do some search, e.g. elcomsoft system recovery pro 3.0 build 466 cd.

YES and NO.
If the password is in Vista, there are a number of password retrieval/recovering/zeroing BUT there are a number of FREEWARE utilities too.

If the password is in the laptop MOST recent laptops will NOT allow to reset it by resetting the CMOS. (simply because the password is NOT stored there)

They have a separate chip.Hm, I'm not so familiar with modern laptops, ok. And how do they store password, could you explain, dear Wonko, please

Each specific model may have a workaround or specific removal procedure, through a special hardware, a simple software and/or the need to physically solder/de-solder components.
